(Reuters) – Samsung Electronics Co didn’t persuade an East Texas federal courtroom on Friday to pause the California Institute of Know-how’s high-stakes patent lawsuit towards it whereas it challenges the patents’ validity on the U.S. Patent and Trademark Workplace.
U.S. District Choose Rodney Gilstrap mentioned halting the lawsuit till the Patent Trial and Attraction Board opinions the patents would unnecessarily delay the courtroom case and prejudice Caltech.
Caltech had no touch upon the choice. Representatives for Samsung and Caltech didn’t instantly reply to a request for remark.
Caltech sued Samsung after it received a $1.1 billion California jury verdict in 2020 towards Apple and Broadcom in a dispute over among the identical patents. A U.S. appeals courtroom tossed the decision final 12 months and remanded for a brand new trial on damages.
The varsity’s 2021 lawsuit alleges Samsung’s Galaxy telephones, tablets, watches and Wi-Fi-enabled Samsung merchandise like televisions and fridges infringe its data-transmission patents.
Caltech has individually sued Microsoft, Dell and HP over the patents. Samsung challenged their validity on the USPTO final 12 months.

However Gilstrap mentioned Friday that pausing the case would “do nothing greater than draw out the time to trial,” and that he couldn’t decide whether or not the PTAB challenges would simplify the lawsuit as a result of the board had not but determined whether or not to listen to them.
Gilstrap additionally mentioned a pause would “require the events to sink further sources into the case,” which has already been happening for over a 12 months, “all of the whereas suspending Caltech’s vindication of its patent rights.”
The Texas case is scheduled to go to trial in September. The board’s ultimate selections on patent validity could be due in November.
