According to a press statement, involuntary killing is a fourth degree felony in New Mexico. It can be punished with up to 18 months in prison and a maximum $5,000 fine. Another involuntary murder in the commission or performance of a lawful activity is a fourth-degree felony that can be punished by up to 18 month imprisonment and a maximum fine of $5000. Since a firearm was involved, this offense is subject to mandatory five year imprisonment.
Luke Nikas Baldwin’s attorney stated that in a statement on Thursday, “This decision distorts Halyna HUTCHINS’ tragic death. David Halls’ assistant director signed a plea deal for negligent use of deadly weapon. In a statement, the attorney said that “Mr. Halls was charged with a petty misdemeanor. This is the best outcome for Mr. Halls and the case. Halls can now move on from this case and let the tragedy of the shooting victims and the changing industry focus to ensure that this kind of accident does not happen again. He was charged with a minor misdemeanor. No jail time. Unsupervised probation. $500 fine. Mr. Halls denies giving a firearm in exchange for Mr. Baldwin.”
Hutchins (42 years old) was killed after Baldwin’s prop gun that contained live rounds was found to have been loaded by him. Director Joel Souza Baldwin also sustained injuries in the incident.
